Bear in mind that some contracts are exchanged and come into force
before the Government side of the equation are aware of the
ramifications of some clauses. It may also be that there were some TBDs
in there.
The Inland Revenue head man, Nicholas Montagu, was not aware that in the
event that their PFI contractor went under, the banks would then own
the department's building. If you can miss something like that,
anything's possible.
